I'm currently on a H-1 B visa going to India to get it stamped this Dec. What I want to know is, if I can work next year part-time for 3-5 hrs a week on another job while continuing my present full-time job too. Is this legal?

I'm wondering if criminal charges that never lead to a conviction (3 charges in total) can cause a green card holder to get deported? Also, when a person applies to renew a green card after it expired will another FBI fingerprint check be done?

I am on H1B visa and my wife has filed N400. We have been married for 1 year and 2 months. she just gave her finger printing on June 10th. we have not yet filed I130 petition as of yet as we were thinking to do that after she gets her citizenship. But today I got laid off from work and the immigration officer mentioned that my wife should file I130 ASAP to avoid deportation. In form I30 On line Item 15 it says to enter the name and address of present employer. I got laid of from work on June 19 today and my wife is filing this I130 petition on Monday June 23. My termination letter indicates june 19th date. I will receive my last pay stub on July 3rd.
Should I put the name of the current employer on line 15 or should I say "unemployed" and explain in a seperate piece of paper about recent layoff? I will be out of status and will be inviting immigration if I mentioned that. Please help.
I assume your wife is not yet citizen. As a spouse og GC holder Applying I-130 does not change anything . wait until your wife gets citizenship and apply. Otherwise you have to conversion

This is an immigration concept called conditional residency. We represent many individuals who apply for permanent residency through their marriage to a US citizen. Though I am still stuck at LC process, I am curious to know if you are required to attach copies of W2 or tax returns with your I485 application? Is there any specific requirement from USICS on this or recent paystubs and letter from employer should be enough?

My I140 (and I485) were filed in May 2010 (EB2, NSC). My attorney just notified me they received an RFE regarding my eduction. Apparently USCIS needs more details on my MSc degree from Poland (integrated, 5 years) and explanation why is it equivalent US masters degree.
Has anyone had a similar hurdle when filing under EB2 with a degree like that? Should I be terribly worried about getting my I140 approved or do cases like that normally go through (provided that an RFE is correctly replied to)?

Hi,
I will be sponsoring US visitor's visa for my parents. They will be going to Kolkata consulate for visa interview. I believe my parents need to carry my Birth Certificate along with other documents for the interview. Do they need to carry my original birth certificate or copy of my birth certifcate is fine.

In Ohio, they issue a DL for one year from the application for H1B extension if the H1B has not been approved yet. It might be the same case in NC as well - it might be worth checking.

Since your attorney is not filing (No G28 is filed when you DIY). I did this and I got approval for both EAD/AP in a month's time.

The AC21 document covers before I-485 filing stage. But not covering after 485 filed and retrogressed situation.

This is really stupid of USCIS to assume that we would stay in the same position for 6-7 years before they can re open the case.
I don't know the answer to your question, but I would think if you are staying at the same place with the same company shouldn't be an issue as long as you stay in the same department.
e.g. if you start in IT as an engineer and then during the GC process you change to a managerial role this should be o.k.
But it you shift from IT to sales with the same salary there would be an issue.
